ࡱ> DFC bjbj 4   8?$c .o```P.R.R.R.R.R.R.${03~v.``v..yyy|P.yP.yyr (T )_qR])^(<..0.l(3)(3 ) )&30) `by```v.v.Q(```.3````````` : energy: the battle that is not hot air Baron Frankal Europes energy comes mostly from gas and electricity, which is mostly imported, and from countries with what can politely be called a potential for unpredictability, as recently shown by Russias argument with Belarus, causing Germanys oil supply to be shut off. Add in Europes ageing infrastructure with massive investment needs and everyone agrees that something must be done. Hence, energy is top of agenda of the European Councils Spring meeting - thats Prime-Ministers to you and me. The plans have two key points. First, cut down usage, tying in neatly with Europes newfound (and very welcome) desire to set the global standard in avoiding global warming. Second, and this is where tempers heat up, the Commission, supported by the UK, Scandinavians, Hungary and others would like to see - attention, euro jargon approaching - unbundling. What this means is separating off ownership of vital infrastructures, such as power lines, from the business of actually supplying customers, which should be a competitive pan-European market. For now, we still have basically national markets, with very few interconnectors, meaning captive customers and little capacity to deal with a crisis. This is despite markets being already, in theory, open to competition. The problem is that in most countries the same big company (Gas de France, Germanys E.ON, Austrias OMV) dominates the national markets and controls both infrastructure and supply. Incumbents have little incentive to invest heavily to redesign systems to open them to competitors. Yet, the economics show that a genuine internal market would help secure supply and bring down prices. The plan also has opponents, most vocally France, whose minister fears that unbundling could weaken European energy groups where size is a determining factor. Germany too, while more discreet, is resolutely opposed. This is enough to block the plans, making the likely outcome a hybrid system which leaves infrastructure ownership with incumbents, but sees its management moved to so-called Independent System Operators (ISOs). However, unbundling has strong support in the European Parliament, a leading MEP talking of another example of blatant French protectionism. Given its strong performance in virtually dictating the Services Directive, Parliaments opinion may yet be very important, particularly if it forms a united front with the Commission against a divided Council. Expect a slow-motion, but eventually bloody battle to take place. And the Commission has a secret weapon up its sleeve: its anti-trust muscles, which it recently flexed by fining Siemens and ThyssenKrupp record amounts. It has already held an enquiry into the energy sector, concluding there is a systematic conflict of interest and evidence of the exclusion of rivals from infrastructures and collusion in the form of market sharing. The March battle may be lost, but Europes consumers should not give up hope of eventually winning the energy war.
